Staff Management Explores the Issue of Employee Misclassification

Staff Management, the industry’s leading provider of sustainable temporary staffing and contingent workforce management solutions, announces the publication of a new white paper entitled The Slippery Slope of Employee Misclassification: An Independent Contractor Primer. Employee Misclassification is a hot-button topic on the minds of key decision makers at companies across the country. The white paper examines issues that companies face when it comes to employee classification, including the differences between employees and independent contractors, how companies can unintentionally get themselves in a risky position and the legal implications for employee misclassification.

“Employee misclassification is becoming a larger issue as it relates to contingent workforce management,” states Chris Abbeduto, Staff Management Vice President of Vendor Managed Services. “It is important for companies to understand the key differences between employees and independent contractors to avoid unintentionally putting themselves at risk for legal action.”

The white paper is designed to help promote understanding of employee classification. In many cases, companies do not misclassify workers on purpose. The need to bring in talent quickly coupled with an unclear understanding of the differences between employees and independent contractors can land companies in trouble. By understanding the legal reasons behind employee classification, a company can avoid those preventable, risky, situations.

Best practices for staying out of harm’s way are also included in the white paper. One of the most important ways to avoid trouble is to consistently audit your positions to determine if all are classified appropriately. Due to increased enforcement of the Fair Labor Standards Act as well as potential changes to legislation, employers should consistently revisit their employee classifications. Someone who was originally hired as an independent contractor may now fall under the appropriate guidelines for an employee. If that is the case, the appropriate steps must be taken to correctly classify that worker.
